Terms and Conditions
Please carefully read the following terms and conditions ("Terms") before booking any services from Foam Around, the "Company." By booking our services, you, the customer, agree to be bound by these Terms.
1. Cancellation Policy:
Cancellations must be done 48hrs prior to your scheduled party to receive a refund, you will receive only 50% refund of total booking fee upon cancellation. If your party cannot be held due to adverse weather conditions, no refund will be given, however you will have 1 calendar year from original date of party to rebook at a later date. Rescheduling will be accommodated free of charge. This policy is to protect every customer's ability to book their desired Date and Time slot.
2. Acknowledgment of Risks:
By booking services from Foam Around, customers acknowledge the inherent risks associated with the use of or participation in our services. These risks include but are not limited to bodily or physical injury, harm, or death that may arise from the activities involved in our services.
3. Assumption of Responsibility:
Customers understand and agree that Foam Around is not responsible for any damages to property, injury of a child, or lost or stolen goods during the course of our services. Foam Around shall not be held liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with the use of our services.
4. Compliance with Safety Rules:
Customers agree to comply with all safety rules and guidelines provided by Foam Around, whether communicated verbally, in writing, or available on the Foam Around website. Failure to adhere to these safety rules may result in termination of services without refund.
5. Risks of Outdoor and Indoor Venues:
Customers acknowledge that attending large outdoor or indoor venues involves certain risks, including but not limited to injuries from exposure to the elements (such as rain, cold, or excessive heat), injuries sustained due to their own negligence or the negligence of others, and injuries or illnesses resulting from reckless behavior. Foam Around shall not be held responsible for such incidents.
6. Health and Physical Condition:
Customers are responsible for knowing their own health and physical condition and limitations. Foam Around is not responsible for assessing the health and physical condition of any customer or any minor under the customer's care or supervision.
7. Use of images & videos for advertising purposes:
I give Foam Around Inc permission to use images or videos taken during party venues for the purposes of advertising and promoting the Company, deemed appropriate by the Company in its reasonable discretion, except to the extent expressly prohibited by law. If you would like to be exempt from this policy, please notify staff during or prior to the party venue. At any time if you choose to have images or videos not used for advertising or promotional purposes and taken down, please notify Foam Around Inc and we will honor your request.
8. Booking Confirmation:
Booking our services confirms that customers have read, understood, and agreed to these Terms and Conditions. It is the customer's responsibility to ensure that all participants are aware of and adhere to these Terms.
9. Indemnification:
Customers agree to indemnify and hold Foam Around harmless from any claims, liabilities, damages, or expenses arising out of or in connection with the use of our services, including but not limited to legal fees and costs.
10. Modification of Terms:
Foam Around reserves the right to modify or update these Terms and Conditions at any time. Customers are encouraged to review the Terms regularly for any changes.
11. Governing Law:
These Terms and Conditions are governed by and construed in accordance with the laws of the state of Florida. Any disputes arising out of or related to these Terms shall be subject to the exclusive jurisdiction of the courts in the state of Florida.
BY BOOKING OUR SERVICES, CUSTOMERS ACKNOWLEDGE THAT THEY HAVE READ, UNDERSTOOD, AND AGREED TO THESE TERMS AND CONDITIONS. IF YOU DO NOT AGREE WITH THESE TERMS, PLEASE REFRAIN FROM BOOKING SERVICES FROM FOAM AROUND.
